Effective July 27, 2025, Employers may no longer require a driver’s license as a condition of employment or include such a requirement in job postings, unless a driving is an essential function of the job or driving is related to a legitimate business purpose.
Violations may result in a citation issued by the Department of Labor & Industries, in addition to monetary penalties.
Employers are encouraged to review their application and hiring process, to include analyzing the essential functions of each position individually. Remember that driving may be an essential function for certain members of your team but not for others.
Job descriptions are a best practice for all employers and should be created for every position within your organization.
