Federal Poster Update Required
The federal Pregnant Workers Fairness Act (PWFA) takes effect on June 27, 2023. The PWFA requires employers to post a notice describing the various protections under the new law. On June 27th, employers should remove their old EEOC “Know Your Rights” posters and replace them with the updated version found here.
The PWFA requires public and private sector employers with at least 15 employees to engage in the interactive process and provide reasonable accommodations to an employee’s known limitations related to pregnancy, childbirth, or related medical conditions, unless accommodation would create an undue hardship for the employer. The terms “reasonable accommodations” and “interactive process” have the same meaning as in the Americans with Disabilities Act (ADA).
